Regulatory landscape
The Czech crypto regime in 2026 — MiCA is in force
EU Regulation 2023/1114 on markets in crypto-assets (MiCA) entered full effect on 30 December 2024. The Czech Republic's implementing legislation — Act No. 31/2025 Coll. on the digitalisation of the financial market (the "Digital Finance Act") — came into force on 15 February 2025. As of 1 July 2026, the transitional arrangements have ended. Only fully authorised CASPs may now operate legally in the Czech Republic (and across the EU under passporting).
Pre-MiCA regime (historical reference)
Before 30 December 2024, Czech law required a binding trade licence — "Poskytování služeb spojených s virtuálním aktivem" — plus AML obligations overseen by the Financial Analytical Office (FAÚ). Sole traders could hold this licence. The trade-licence route for in-scope MiCA services is now closed for new applicants.
Current MiCA regime (from 1 July 2026)
The Czech National Bank (ČNB) is the competent authority for CASP authorisations. By February 2026, ČNB had received 248 applications and issued its first six authorisations. Only legal entities (not sole traders) may apply. Authorised CASPs can passport their Czech licence across all 27 EU member states — a significant advantage of the Czech route.

AML obligations
FAÚ, AML and the Travel Rule
The Financial Analytical Office (Finanční analytický úřad — FAÚ) retains AML/CFT supervisory powers over all crypto businesses in the Czech Republic, including MiCA-authorised CASPs. ČNB supervises prudential and MiCA-specific requirements; FAÚ supervises the AML/CFT programme.
Every Czech CASP must maintain:
- A written AML/KYC programme (risk assessment, customer due diligence, enhanced due diligence for PEPs)
- Travel Rule compliance (transfer of information requirements for crypto-asset transfers)
- Suspicious transaction reporting to FAÚ
- Internal controls and compliance officer appointment
- ICT security and cybersecurity controls

Do I need a Czech CASP authorisation under MiCA to offer crypto services in 2026?
Yes — as of 1 July 2026, all crypto-asset service providers (CASPs) operating in the Czech Republic must hold a MiCA CASP authorisation issued by the Czech National Bank (ČNB) or passport an authorisation from another EU member state. The transitional period that allowed entities with a pre-existing Czech trade licence to operate ended on 1 July 2026. Only fully authorised CASPs may now operate legally.
Who issues the CASP authorisation?
The Czech National Bank (Česká národní banka — ČNB) is the competent authority for MiCA CASP authorisations in the Czech Republic. ČNB issued its first six CASP authorisations in February 2026 and had received 248 applications by that date. The ČNB is also responsible for ongoing supervision, enforcement and client-protection oversight.
What were the pre-MiCA trade licence requirements (VASP)?
Before MiCA took full effect (30 December 2024), Czech law required entities providing crypto-asset services to hold a binding trade licence for "Poskytování služeb spojených s virtuálním aktivem" (provision of services related to virtual assets). Crypto businesses were also subject to AML obligations overseen by FAÚ (Finanční analytický úřad — the Financial Analytical Office). The trade-licence regime has now been superseded by MiCA for in-scope activities.
What are the MiCA CASP capital requirements?
MiCA divides CASP authorisations into three classes by service risk: Class 1 (EUR 50,000 minimum capital) — basic advisory and order-placement services; Class 2 (EUR 125,000) — custody/administration and exchange services where the provider holds client funds; Class 3 (EUR 150,000) — operation of a crypto-asset trading platform. Minimum capital must be maintained on an ongoing basis.
What is the role of FAÚ for crypto businesses under MiCA?
The Financial Analytical Office (FAÚ) retains supervisory powers for AML/CFT compliance across all crypto businesses in the Czech Republic — both MiCA-authorised CASPs and any residual VASPs that fall outside MiCA scope. All entities must implement AML/KYC programmes, Travel Rule compliance and suspicious transaction reporting to FAÚ regardless of licensing status.

What ongoing accounting and compliance obligations does a Czech CASP have?
Czech CASPs must maintain Czech-language accounting records under Czech accounting standards, file annual financial statements in the Commercial Register, submit corporate income tax returns (21% rate), handle VAT if turnover exceeds 2 000 000 Kč, and maintain AML programme documentation. All filings use the mandatory datová schránka (government data inbox).
